Tiger Woods Scorecard Challenge Official Rules (the "Official Rules")

Introduction
The object of The Tiger Woods Scorecard Challenge (the "Contest") is to most accurately predict the scores recorded by Tiger Woods in at least five (5) professional stroke play format golf tournaments in which Tiger Woods competes from June 10, 2009, through December 31, 2009. To enter a prediction for an applicable tournament, you must complete an online entry form where you predict (a) the total score Tiger Woods will record for each of the first three (3) rounds of the applicable tournament and (b) the score Tiger Woods will record for each of the eighteen (18) individual holes in the fourth round of the applicable tournament, should he advance to the fourth round of play.
Eligibility
The Contest is open only to legal residents of the fifty (50) United States, Washington D.C. and Canada (excluding residents of the Province of Quebec) who are of legal age of majority in their jurisdiction of residence (and at least eighteen (18) years of age in the U.S.) as of the date of entry and have a valid e-mail address and Internet access as of June 10, 2009. Void in the Province of Quebec and where prohibited by law, rule or regulation.
Employees or consultants of ETW Corporation, the MLB Entities (defined below) or any of their respective parents, affiliates, subsidiaries or advertising and promotion agencies, their immediate family members (parent, sibling, child or spouse and their respective spouses, regardless of where they reside) and any person residing in their same household, whether or not related, are not eligible to participate or win a prize. The "MLB Entities" shall mean MLB Advanced Media, L.P. ("MLBAM"), the Office of the Commissioner of Baseball, its Bureaus, Committees, Subcommittees and Councils, Major League Baseball Enterprises, Inc., Major League Baseball Properties, Inc. , the Major League Baseball Clubs, Tickets.com, Inc., SportsOnEarth, LLC and each of their respective subsidiaries or affiliated entities, any entity which, now or in the future, controls, is controlled by, or is under common control with the Major League Baseball Clubs or the Office of the Commissioner of Baseball, and the directors, officers, employees and agents of the above entities.
How to Enter
You may enter to participate in the Contest from 1:00 p.m. Eastern Time ("ET") on June 10, 2009, through 11:59 p.m. ET on December 31, 2009 (the "Contest Period"). To participate during the Contest Period, visit http://web.tigerwoods.com/ and follow the banners, buttons and/or links for the Contest entry form. By submitting all required information you will be entered in the Contest and be a "Participant". Participants will be given the option to receive (a) commercial e-mails from tigerwoods.com; however, eligibility to participate in the Contest is not dependent upon Participant's consent to receive such e-mails.
All information submitted by participants is subject to, and will be treated in a manner consistent with, TigerWoods.com's Website Terms of Use accessible at http://web.tigerwoods.com/about/termsOfUse and Privacy Policy accessible at: http://web.tigerwoods.com/about/privacyPolicy. Participants must fully complete and submit all non-optional data requested on the online entry form. Incomplete entries are void. Entries generated by script, macro or other automated means will be void.
Game Administration
By participating, each participant agrees that MLBAM will solely resolve any disputes and rules violations that arise in connection with the Contest. All decisions by MLBAM regarding the Contest shall be final and binding in all respects. Any incidence of collusion or cheating, as determined by MLBAM in its sole discretion, will be subject to disqualification from the Contest without limitation to any other rights or remedies available to MLBAM. Making your Predictions
The goal is to accurately predict the following scores recorded by Tiger Woods in at least five (5) professional stroke play format golf tournaments in which he competes from June 10, 2009, through December 31, 2009: (a) Tiger Woods' score for each of the first three (3) rounds of play and (b) Tiger Woods' score for each of the eighteen (18) holes in the fourth round of play, should he advance to the fourth round.
To enter your prediction, use the online entry form and, in accordance with the "Prediction Deadline" requirements detailed below, fill in your predicted scores for an upcoming or in-progress professional stroke play format golf tournament in which Tiger Woods is competing or scheduled to compete.
In addition, you must also enter an answer to each of the below-listed tiebreaker questions. In the event of a tie for any Tournament Prize, the winner will be determined by greatest prediction accuracy to the first tiebreaker question, and to the second and third tiebreaker questions should the prior questions not resolve the tie.
- 1. Total putts that Tiger Woods records in Round 4 of applicable tournament
- 2. Distance of longest drive for Tiger Woods in Round 4 of applicable tournament
- 3. Total birdies for Tiger Woods in Round 4 of applicable tournament
In the event that there is still a tie after all three Tournament Prize tiebreakers have been scored or in the event of a tie for the Grand Prize, the following tiebreaker will be used to break the tie:

In the event that there is a tie when Tiger does not play in the fourth round for any reason, there will be a random drawing -- completed by the Judges -- among those tied for first place to determine the sole winner.
Limit one (1) entry per unique e-mail address. If a user submits multiple entries using the same e-mail address, only the most recent submission will be considered. TigerWoods.com's computer shall be the official clock of the Contest.

Prediction Deadline
You must submit your predictions by 12:00 a.m. ET on any day of applicable play. For an upcoming or in-progress applicable tournament, your predicted score for round one play must be submitted by 12:00 a.m. ET on the day round one begins. Your predicted score for round two play must be submitted by 12:00 a.m. ET on the day round two begins. Your predicted score for round three play must be submitted by 12:00 a.m. ET on the day round three begins. Your predicted score for each hole of round four play must be submitted by 12:00 a.m. ET on the day round four begins.
Scoring
Rounds One, Two and Three (1-3)
For each of the first three (3) rounds of play for an applicable tournament, if you correctly predict Tiger Wood's score, you will receive minus-three (-3) points. If your predicted score for any the first three (3) rounds of play for an applicable tournament is incorrect, you will receive points equal to the "absolute value" of the difference between your predicted score and Tiger Woods' official score. For Contest scoring purposes, "absolute value" shall mean the positive value of a number without regard to its sign. For example, in this Contest, the "absolute value" of (+4) is 4 and the "absolute value" of (-4) is 4.
NOTE: If you fail to make a prediction for a round of play prior to that round's submission deadline, you will receive a plus-ten (+10) point penalty.
- Example: If for round two, you predict Tiger Woods will shoot a sixty-eight (68), and he does shoot a sixty-eight (68), you receive minus-three (-3) points.
- Example: If for round two, you predict Tiger Woods will shoot a sixty-eight (68), and he shoots a seventy-one (71), you receive plus-three (+3) points.
- Example: If for round two, you predict Tiger Woods will shoot a seventy-one (71), and he shoots a sixty-eight (68), you receive plus-three (+3) points.
Round Four
For each hole in the fourth (4th) round of play of an applicable tournament, if you correctly predict Tiger Woods' score, you will receive minus-one (-1) point. If your predicted score for any hole in the fourth round of play of an applicable tournament is incorrect, you will receive points equal to the "absolute value" of the difference between your predicted score and Tiger Woods' official score. Notwithstanding the foregoing, the maximum positive point value you can receive for any fourth round hole is plus-ten (+10).
If you fail to enter a prediction for all 18 holes on round four prior to the fourth round's submission deadline, you will receive a plus-thirty-six-point (+36) penalty.
- Example: If on hole seven (7), you predict Tiger Woods will shoot a three (3), and he shoots a three (3), you receive minus one (-1) point.
- Example: If on hole seven (7), you predict Tiger Woods will shoot a three (3), and he shoots a five (5), you receive plus-two (+2) points.
- Example: If on hole seven (7), you predict Tiger Woods will shoot a five (5), and he shoots a three (3), you receive plus-two (+2) points.
If Tiger Woods misses any rounds or holes due to injury, disqualification, missing the cut or an act of God, only the rounds or holes Tiger Woods played will count toward scoring; all users will receive zero (0) points for all unplayed rounds or holes.
Playoff holes will not be included in Contest scoring.
If Tiger Woods submits a scorecard that is officially corrected within one (1) week of the completion of the tournament, the game will be rescored to account for the updated scores.
Your total score for each tournament in which Tiger Woods competes is the cumulative total from all Contest points received from the four (4) rounds of tournament play.
Your final overall Contest score is the cumulative total from each of your five lowest individual tournament scores (the "Final Overall Score").
The Tournaments Prizes
For each professional stroke play format golf tournament in which Tiger Woods competes during the Contest Period, the eligible participant who has accrued the lowest point total during such individual tournament (a "Tournament Winner") will win one (1) EA Sports Tiger Woods PGA Tour 10 video game (the "Tournament Prize"). (Estimated Retail Value ("ERV") of Tournament Prize: $60). TOURNAMENT PRIZE WINNERS WILL BE ELIGIBLE FOR THE GRAND PRIZE
The Grand Prize
After Tiger Woods completes his final tournament of 2009, the eligible participant who has competed and recorded points for at least five (5) of Tiger Woods' tournaments and who has the lowest Final Overall score will be declared the grand prize winner.
NO PRIZES WILL BE AWARDED IF NO PARTICIPANT ACHIEVES A SCORE OF ZERO (0) OR BELOW.
If Tiger Woods plays fewer than five (5) applicable tournaments during the Contest Period, Participants' Final Overall Score will be calculated for the number of applicable tournaments in which Tiger Woods competed during the Contest Period. For example, if Tiger Woods competes in four (4) applicable tournaments during the Contest Period, each Participant's Final Overall Score will be the cumulative total from each of his/her four (4) lowest individual tournament scores.
The eligible participant who has accrued the lowest Final Overall Score during the Contest Period (the "Grand Prize Winner") will win the Grand Prize consisting of: (a) one (1) Tiger Woods AT&T replica Nike golf staff bag; ( b) fourteen (14) Tiger Woods replica Nike golf clubs; (c) one (1) pair of Tiger Woods replica Nike golf shoes; (d) twenty four (24) Nike ONE TOUR golf balls; (e) six (6) Nike golf gloves; and (f) one (1) set of four (4) Nike Tiger Woods collection shirts ((a), (b), (c), (d), (e) and (f), collectively, the "Grand Prize"). (ERV of Grand Prize: $4,000).
The Prizes are non-transferable and non-assignable, with no cash redemption except in ETW Corp.'s sole and absolute discretion. ETW Corp. reserves the right to substitute a prize with one of comparable or greater value at its sole and absolute discretion. All prize details, including seat locations, are at the sole and absolute discretion of ETW Corp. Each Winner is fully responsible for any and all applicable federal, state, provincial and local taxes (including income and withholding taxes). All costs and expenses related to the acceptance and use of any prize including, but not limited to, all transportation costs, lodging, meals gratuities and souvenirs, not specified herein as being provided are the sole responsibility of the Winner. Tournament dates and times are determined in the sole discretion of the tournament organizers and may be subject to change.
The ETW Corporation, the MLB Entities and each of their respective parent companies, trustees, subsidiaries, franchisees, affiliates, licensees, agents, independent contractors and advertising and promotional agencies and each of their respective officers, directors, agents and employees (collectively, the "Released Parties") will not be responsible for Acts of God, acts of terrorism, civil disturbances, work stoppage or any other natural disaster outside their control, that may cause the cancellation or postponement of any professional golf tournament.
Notification
Each potential winner will be notified by e-mail and/or telephone (in MLBAM's discretion) and may (in MLBAM's discretion) be confirmed by postal mail, return receipt (the "Prize Notification"). In the event that a potential winner does not respond to any such Prize Notification within five (5) days of date of issuance, a disqualification will result, and prize will be forfeited and, at MLBAM's sole discretion, awarded to the runner-up (if applicable). Each winner may be required to submit his/her valid social security number and/or other identification to MLBAM's and shall be required to execute, have notarized and return an Affidavit of Eligibility (or, if a resident of Canada, a Declaration of Eligibility) and Release of Liability and, where legal, Publicity within three (3) days of date of issuance. Failure to submit any identification required by MLBAM or to return the required documents within the specified time period, noncompliance with these Official Rules or the return of any prize or Prize Notification as undeliverable may result in disqualification, and prize will be forfeited and, at MLBAM's sole discretion, awarded to the runner-up (if applicable).
LEGAL DISCLAIMERS
General Conditions
By registering and/or participating, each participant accepts and agrees to be bound by these Official Rules, the TigerWoods.com Privacy Policy and Website Terms of Use, and by the decision(s) of MLBAM which shall be final and binding in all respects.
Each participant agrees to allow MLBAM and its designees to use their names and likenesses in any and all mediums now or hereafter known for advertising and publicity purposes throughout the world in perpetuity, without any compensation, notification or permission, unless prohibited by law.
All applicable federal, state, provincial and local laws and regulations apply. This Contest and these Official Rules will be governed by the laws of the State of New York. Any court of competent jurisdiction sitting within the State of New York, New York County will be the exclusive jurisdiction and venue for any dispute arising out of or relating to this Contest or these Official Rules. MLBAM's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
Released Parties are not responsible for lost, late, stolen, garbled, delayed, undelivered or misdirected entries, selections or registrations, for incorrect, inaccurate or incomplete entry information whether caused by a participant, equipment, or technical malfunction or for any human error, technical error or malfunctions.
Released Parties are not responsible for any technical, computer, network, typographical, printing, human or other errors relating to or in connection with this Contest, including, without limitation, errors or problems which may occur in connection with the offer or administration of this Contest, the processing of entries, selections or registrations, the tabulation of scores, the cancellation of games or any errors appearing in any Contest related-materials, including, but not limited to errors in advertising, the Official Rules, the selection and announcement of the Grand Prize Winner or the distribution of the prizes. MLBAM reserves the right to modify these Official Rules for clarification purposes without materially affecting the terms and conditions of the Contest.
The Released Parties make no warranties, express or implied, relative to the use or enjoyment of any prize or portions thereof, including without limitations, its quality, merchantability or fitness for a particular purpose. By entering the Contest, each participant agrees to indemnify, hold harmless and fully release the Released Parties from any and all liability for any injuries, losses, death, or damages of any kind caused by participation in the Contest, any prize or resulting from the acceptance, possession, quality, use or misuse of any prize, or any portion of any prize, including any travel or activity related thereto.
The Tiger Woods Scorecard is a skill contest designed to increase consumer awareness of and interest in TigerWooods.com, the Official Site of Tiger Woods. This Contest may not be used for, or in connection with, any form of gambling.
Rules/Winners Information
For winner information (available after January 1, 2009) or an additional copy of the Official Rules, send a self-addressed, stamped envelope to: Tiger Woods Scorecard Challenge, MLB Advanced Media, 75 Ninth Avenue, New York, NY 10011. Specify "Rules" or "Winner List." Requests must be received by September 30, 2009. Residents of Vermont and Canada may omit return postage on rules requests.
Internet
If for any reason the Contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, cancellation of games or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, MLBAM reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Contest and, if terminated, to determine the winners, if any, from among all eligible, non-suspect scores achieved up to the point of termination.
The Released Parties assume no responsibility for any error, omission, interruption, deletion, difficulties, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. The Released Parties are not responsible for any problems or technical malfunction of any telephone network, cable, satellite, Internet Service Provider (ISP) or lines, computer systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received on account of technical problems or traffic congestion on the Internet or at any Web site, or any combination thereof, including any injury or damage to participant's or any other person's computer related to or resulting from participation or downloading any materials in this Contest.
CAUTION: ANY ATTEMPT BY A PARTICIPANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE CONTENT OR LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, MLBAM WILL DISQUALIFY ANY SUCH PARTICIPANT AND RESERVES THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEYS' FEES) AND OTHER REMEDIES FROM ANY SUCH PARTICIPANT TO THE FULLEST EXTENT PERMITTED BY LAW.
All entries must include a valid e-mail address for the participant. In the event of a dispute as to the identity of a participant, an entry will be declared made by the Authorized Account Holder of the e-mail address submitted at the time of entry provided he/she is eligible according to these Official Rules. "Authorized Account Holder" is defined as the natural person to whom the applicable Internet service provider or other organization (such as a business or educational institution.) has assigned the e-mail address for the domain associated with the submitted e-mail address.
In the event that the Contest is challenged by any legal or regulatory authority, MLBAM reserves the right to discontinue or modify the Contest, or to disqualify participants residing in the affected geographic areas. In such event, the Released Parties shall have no liability to any participants who are disqualified due to such an action.
